Terms of Service
Introduction
Welcome to Vivant & Vow™. These Terms of Service (the "Terms") describe the agreement between you and Vivant & Vow™ ("Vivant & Vow™," "we," "us," or "our") when you access or use our websites, wedding-planning software, paid subscriptions and passes, community spaces, educational resources, and AI-assisted planning experiences (together, the "Service").
We have written these Terms to be read, not endured. They explain what you can expect from us, what we ask of you, and where each of our responsibilities begins and ends. By purchasing access, creating or activating an account, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Version 4.1 · Last Updated August 25, 2026
HOW THESE TERMS FIT TOGETHER
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Where we publish additional policies — including Community Guidelines, an Acceptable Use Policy, Cookie Policy, AI & Personalization Policy, Subscription & Billing Policy, or Testimonial & Media Use Policy — those policies are likewise incorporated into these Terms.
\n\t
\n\tWhere a specific policy conflicts with these Terms, the more specific policy governs for its subject matter.
1. Definitions
A few terms appear throughout this document. For clarity:

MEMBER ("YOU")
Any person who purchases access, activates or creates an account, or uses the Service.
AI FEATURES
Any part of the Service that uses artificial intelligence to generate, summarize, calculate, organize, recommend, or personalize content.
SUBSCRIPTION
Recurring paid access billed monthly or annually until canceled.
JOURNEY PASS
A one-time paid access option with a defined access period rather than an automatically renewing subscription.
A NOTE ON GROWTH
Vivant & Vow™ is growing. Unless we state otherwise, these Terms apply to current and future Vivant & Vow™ features and experiences that form part of the Service. A new feature may also be subject to supplemental terms presented when you use it.
2. Who May Use the Service
You must be at least 18 years old and able to enter into a binding contract. The Service is intended for adults planning a wedding or celebration, and for the people they lawfully invite into that process.
You agree to provide accurate information when you purchase access, activate or create your account, or enter wedding information, and to keep material account information current.
3. Purchase, Account Activation & Your Account
PURCHASE AND ACTIVATION
Paid access may be purchased before you create or activate your IAS account. After a successful purchase, we may use the email address and other information provided at checkout to establish your access entitlement and send account-activation or access instructions.
You may receive a transactional email containing a secure link to create or activate your account, set your password, or otherwise access the Service. You are responsible for using an email address you can access and for completing the activation steps provided. If you do not receive your access instructions, contact support@vivantandvow.com so we can verify the purchase and resend or otherwise assist with access.
Successful payment creates the applicable paid access entitlement even if account activation is not completed immediately. Account activation, however, may be required before you can use IAS or other authenticated features.
ACCOUNT SECURITY AND RESPONSIBILITY
You are responsible for safeguarding your password and for activity under your account. Accounts are personal and may not be sold, transferred, or shared outside the people and permissions expressly supported by the Service.
If you believe someone has accessed your account without permission, contact support@vivantandvow.com promptly. We may require reasonable verification before making account or billing changes.
We may suspend or close accounts that remain inactive for an extended period after reasonable notice, subject to applicable law and any active paid access.
4. What the Service Is — and Is Not
Vivant & Vow™ provides wedding-planning software, organizational tools, educational content, community spaces, and AI-assisted guidance designed to help you organize and navigate your wedding-planning season. IAS may include budgeting, timelines, checklists, to-dos, moodboards, venue and vendor comparisons, vendor records, guest management, seating and reception design, bridal-party planning, shot lists, notes, planning wins, prompt libraries, and other planning features that evolve over time.
WHAT THE SERVICE IS NOT
The Service does not provide legal, financial, tax, accounting, medical, mental-health, therapeutic, insurance, or other licensed professional advice. Budget guidance, calculations, vendor tipping guidance, alcohol or quantity estimates, timelines, checklists, planning suggestions, and AI-generated answers are informational estimates or planning aids only.
You are responsible for your planning decisions, contracts, purchases, payments, guest information, vendor relationships, and compliance with laws or venue requirements applicable to your event. We are not a party to agreements between you and any vendor, venue, guest, or third party.
5. Your License to Use the Service
Subject to these Terms and your applicable access rights, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Service for planning your own wedding or celebration.
This license does not permit resale, sublicensing, public redistribution, commercial exploitation, credential sharing, or use of the Service to provide a competing product or service.
6. Your Content
You retain ownership of Your Content, including your wedding details, budgets, notes, guest information, uploaded files and images, seating and reception layouts, vendor records, prompts, and profile information.
You grant us a limited, worldwide, royalty-free license to host, store, process, reproduce, display, back up, transmit, and technically modify Your Content only as reasonably necessary to operate, secure, personalize, support, and improve the Service for you and our members, consistent with our Privacy Policy.
You represent that you have the right and lawful basis to submit Your Content. This is especially important when you enter information about guests, wedding-party members, vendors, or other people. You agree not to upload unlawful, infringing, malicious, or unauthorized content.
We do not routinely monitor private planning content, but we may review, restrict, preserve, or remove content when reasonably necessary to provide support, investigate abuse or security issues, enforce these Terms, or comply with law.
7. Feedback & Suggestions
If you send us feedback, suggestions, feature requests, ideas, or comments about the Service, you grant Vivant & Vow™ a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into our products and business without restriction, attribution, or compensation. Feedback is voluntary and is not confidential.
8. Personalization
The Service is designed to become more useful as you add information about your wedding. You authorize Vivant & Vow™ to use planning details, preferences, wedding information, dashboard activity, feature usage, prompts, and profile information to personalize your experience, surface relevant reminders, pre-populate connected features, improve recommendations, and make AI responses more relevant to the wedding you are planning.
For example, where technically available and appropriate, an AI Feature may use guest count, budget, vendor, timeline, checklist, or other planning information already stored in your account so that you do not have to repeat information you have already provided. Personalization is subject to the Privacy Policy and to the technical capabilities of the Service at the time you use it.
9. Artificial Intelligence Features
The Service may use artificial intelligence to provide planning assistance, calculations, recommendations, drafting help, educational guidance, summaries, reminders, comparisons, and personalized suggestions.
PLEASE VERIFY IMPORTANT OUTPUT
AI output may be incomplete, inaccurate, outdated, or inappropriate for your specific circumstances. It may also make assumptions. You should independently verify information that affects money, contracts, safety, legal rights, taxes, quantities, vendor obligations, event logistics, or other important decisions.
AI Features may be provided in part by third-party AI and technology providers operating under their own service arrangements with us. The models, providers, capabilities, and data flows used to deliver AI Features may change over time, as described in our Privacy Policy.
We do not promise that any AI Feature will remember every prior interaction, access every piece of your planning data, or produce the same answer each time.
10. Ava by Vivant & Vow™ and Conversational Planning
The Service may include Ava by Vivant & Vow™ ("Ava"), our AI-assisted wedding planning companion, together with related prompt libraries and conversational planning experiences. Ava is an automated system — not a human planner, attorney, accountant, therapist, medical professional, or other licensed professional. Ava may help you think through planning questions, organize information, draft language, estimate quantities, compare options, or identify next steps, but you remain responsible for deciding what is appropriate for your wedding.
Where enabled, Ava may use information already stored in your IAS account to provide more relevant answers. This may include your wedding date, expected guest count, budget information, vendors, tasks, timelines, guest data, and other planning details. The information available to Ava depends on the integrations and permissions active at the time.
PLEASE DO NOT SHARE
Do not enter payment-card numbers, bank credentials, government identifiers, passwords, medical records, or other highly sensitive information into AI conversations.
11. Automated Personalization
The Service may automatically personalize reminders, suggested tasks, checklists, planning priorities, educational content, or AI context based on information you provide.
No legal or similarly significant decision about you is intended to be made solely through automated processing. Personalization is designed to support your planning, not determine your rights or obligations.
12. Marketing, Testimonials & Community Content
Real member experiences may help us explain the Service to others. You grant Vivant & Vow™ a worldwide, royalty-free, non-exclusive license to use Community Content and feedback that you intentionally share in community spaces visible to other members for promotional, educational, product-development, and business purposes, subject to the limitations below.
WHAT WE WILL NEVER USE FOR MARKETING
We will not use private IAS planning data, private AI conversations, specific budget figures, guest lists, uploaded private documents, private notes, seating data, or other non-public planning information for marketing without separate permission.
Before using member-created Community Content in marketing, we may crop, reformat, or edit it for clarity. We will remove or obscure personally identifying details unless you separately authorize attribution. You may ask us to stop future promotional use of a particular contribution by contacting support@vivantandvow.com; this does not require us to recall materials already lawfully distributed.
13. Community Standards & Acceptable Use
Our community is intended to be useful, welcoming, and respectful. You agree not to engage in harassment, bullying, threats, intimidation, hate speech, discrimination, impersonation, infringement, scraping, spam, scams, malware distribution, unauthorized automation, security circumvention, unauthorized account access, unlawful uploads, or conduct that materially disrupts other members or our systems.
We may remove content, restrict features, suspend, or terminate accounts that violate these standards. Where separate Community Guidelines or an Acceptable Use Policy are published, they supplement this section.
14. Intellectual Property
The Service and its original content, software, designs, branding, methodologies, and materials are owned by Vivant & Vow™ or its licensors and are protected by intellectual-property laws. This includes, without limitation:
• Vivant & Vow™, Inner Aisle™, Inner Aisle Suite™, Planning Roadmap™, Wedding Compass™, Vendor Energy Check™, Compass Lounge™, Ava by Vivant & Vow™, and other names, marks, and branded experiences we use;
• our software, dashboards, workflows, interfaces, layouts, prompt libraries, and interactive tools
• our proprietary frameworks, curricula, educational materials, templates, checklists, downloads, copy, graphics, photography, and videos
• our logos, trade dress, visual identity, and original product design elements
• future products, features, and original materials we create
These materials may not be copied, reproduced, republished, reverse engineered, resold, redistributed, or used to create derivative or competing products or services except as expressly permitted by law or by our written authorization. All rights not expressly granted are reserved.
15. Copyright Complaints
If you believe content on the Service infringes your copyright, contact support@vivantandvow.com with a description of the protected work, the location of the allegedly infringing material, your contact information, a statement of your good-faith belief that the use is unauthorized, and a statement that your notice is accurate. We may request additional information before acting.
16. Software Restrictions
You agree not to:
• reverse engineer or attempt to derive source code, except where law expressly permits it
• recreate protected workflows for a competing service
• use unauthorized APIs or bulk extraction
• circumvent security, authentication, subscription gating, or access controls
• share or transfer paid access
• use the Service or its output to train or develop a competing AI model or product without written permission
• introduce malicious code
• interfere with normal operation of the Service
17. Data, Backups & Availability
We use commercially reasonable measures to operate, secure, and preserve the Service and the information entrusted to us. We may use cloud hosting, databases, storage providers, and other infrastructure to do so.
No online service can guarantee uninterrupted availability or perfect preservation of data. Data may be delayed, corrupted, lost, or temporarily unavailable because of software errors, third-party outages, infrastructure failures, cyber incidents, human error, maintenance, or events beyond our reasonable control.
Where export features are available, we encourage you to periodically export planning information that is important to you. To the fullest extent permitted by law, Vivant & Vow™ is not liable for loss or corruption of user-generated planning data except to the extent caused by conduct for which liability cannot legally be excluded.
18. Third-Party Services, Links & Vendors
The Service relies on third-party technologies and providers, which may include payment processors, hosting and database providers, email delivery services, authentication providers, AI providers, analytics services, community platforms, file storage, and other infrastructure. Those providers may change as our technology evolves.
We are not responsible for third-party outages, policy changes, pricing changes, degraded performance, or failures beyond our reasonable control. Your direct use of a third-party site or service may also be governed by that provider's terms and privacy practices.
The Service may contain links to wedding vendors, venues, retailers, registries, resources, or other third parties. Unless we expressly state otherwise, a link or reference is not an endorsement or guarantee.
Vivant & Vow™ is not responsible for the services, performance, contracts, pricing, insurance, licensing, availability, conduct, or failures of wedding vendors, venues, planners, photographers, caterers, florists, bar services, entertainers, transportation providers, officiants, or other third parties you choose.
19. Cybersecurity
No online platform can guarantee complete security. You acknowledge the inherent risks of transmitting and storing information online.
Use a strong, unique password; protect your devices; keep your browser and operating system current; and use multi-factor authentication where offered. Notify support@vivantandvow.com promptly if you suspect unauthorized account access.
To the fullest extent permitted by law, we are not liable for hacking, phishing, malware, credential theft, unauthorized access, or cyber incidents beyond our reasonable control.
20. Beta & Preview Features
We may offer preview, early-access, beta, experimental, or incomplete features. They may contain bugs, change substantially, reset data, or be discontinued. Unless we expressly say otherwise, beta or preview features are provided as-is and should not be relied upon for information you cannot independently preserve or verify.
21. Changes to the Service
We may add, remove, redesign, improve, replace, or discontinue features, integrations, dashboards, AI capabilities, community experiences, or educational content as the Service evolves. We will endeavor to communicate material changes to paid access where practical. If we permanently discontinue the paid Service as a whole during a prepaid access period, we will provide any remedy required by law and may provide a prorated refund or comparable remedy where appropriate.
22. Plans, Payment, Renewal & Taxes
Paid IAS access may be offered through monthly subscriptions, annual subscriptions, a Journey Pass, promotional offers, or other plans described at checkout. The price, billing frequency, access period, and material plan terms presented at checkout form part of your agreement with us.
PAYMENT BEFORE ACCOUNT ACTIVATION
Unless a specific offer states otherwise, payment is completed through checkout before paid IAS access is activated. After successful payment confirmation, we may create or record your access entitlement and send instructions for activating or accessing your account. We do not offer a free trial unless we expressly state otherwise in a future written offer.
MONTHLY SUBSCRIPTIONS
Unless canceled, monthly subscriptions automatically renew each month and the payment method on file may be charged the then-applicable subscription price plus any required taxes.
ANNUAL SUBSCRIPTIONS
Unless canceled, annual subscriptions automatically renew for another annual term and the payment method on file may be charged the then-applicable annual price plus any required taxes. Where applicable law requires advance renewal notice, we will provide it.
JOURNEY PASS
The Journey Pass is a one-time purchase and does not automatically renew. Its access period is described in Section 24 and at checkout.
PRICE CHANGES AND TAXES
Prices may change for future billing periods. We will provide notice of price changes when required by law. A price change does not retroactively change a completed one-time purchase.
Taxes are not included unless expressly stated. We may calculate, collect, and remit sales, use, VAT, or similar taxes when required. Your tax treatment may vary by jurisdiction.
Payments may be processed by a third-party payment processor. We do not receive or store your full payment-card number when payment is handled entirely by that processor.
23. Cancellation, Failed Payments & Access
You may cancel an automatically renewing subscription at any time. Cancellation stops future renewal charges but ordinarily does not end access immediately; unless otherwise stated, you retain paid access through the end of the billing period already paid for.
Where you enrolled online, we will provide an online cancellation method or another cancellation method required by applicable law. We will not require you to continue a subscription merely because you stop using the Service.
If a payment is declined, reversed, disputed, or otherwise not successfully completed, we may retry the payment, ask you to update your payment method, limit paid features, pause paid access, or terminate the affected subscription after any notice or grace period we choose to provide or that applicable law requires.
Your underlying account may remain available after paid access pauses or ends so that you can manage billing, export eligible data, reactivate access, or use any free features then available. The existence of an account does not guarantee continued access to paid IAS features.
If you believe a charge is incorrect, contact billing@vivantandvow.com promptly so we can investigate. Nothing in these Terms limits rights you may have under applicable payment-card or consumer-protection law.
24. Journey Pass
The Journey Pass is designed for members who prefer one payment rather than recurring billing.
ACCESS PERIOD
Unless the checkout page states a different access period, Journey Pass access begins when payment is successfully confirmed and continues through ninety (90) days after the wedding date stored in your account, subject to a maximum access period of twenty-four (24) months from purchase.
You are responsible for entering and maintaining an accurate wedding date. If your wedding date changes, we may adjust the access period to reflect the new date, but the maximum access period still applies unless we expressly approve an extension.
A Journey Pass does not automatically renew. If access expires and you wish to continue using paid features, you may purchase another eligible plan then offered. Community access, if included as a benefit, may be governed separately and may continue in a free tier after paid IAS access ends.
25. Refunds
Because the Service provides access to digital software, content, and planning features, payments are generally non-refundable once the applicable paid access entitlement has been established, except where required by law or where a specific offer or written refund policy states otherwise.
Canceling a subscription prevents future renewal charges but does not ordinarily create a refund for the current billing period. Journey Pass purchases are likewise generally non-refundable after access begins.
We may issue refunds or credits in our discretion for duplicate charges, verified billing errors, extended service failures, or other exceptional circumstances. Any discretionary refund does not create an obligation to provide the same remedy in another case.
26. Termination, Expiration & Data Export
You may stop using the Service at any time and may request account deletion by contacting support@vivantandvow.com or by using an account-deletion feature if available.
Before deletion or the end of paid access, use available export or download features to preserve information you want to keep. We may also provide a reasonable post-expiration period for export or account management, but we do not guarantee indefinite storage of planning data after access ends.
We may suspend or terminate access if you violate these Terms, fail to pay amounts due, create security or legal risk, misuse the Service, or where required by law. Where practical and lawful, we will provide notice and an opportunity to remedy.
When an account is deleted from active systems, backup copies, security logs, transaction records, fraud-prevention records, and information required for legal, tax, accounting, or compliance purposes may remain for applicable retention periods. Residual backups are deleted or overwritten in the ordinary course.
Upon termination or expiration, your license to use paid features ends. Provisions that by their nature should survive — including ownership, intellectual property, payment obligations already incurred, disclaimers, liability limits, indemnification, dispute provisions, and general provisions — survive.
27. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES; THAT DEFECTS WILL ALWAYS BE CORRECTED; OR THAT PLANNING CONTENT, CALCULATIONS, ESTIMATES, AI OUTPUT, OR THIRD-PARTY INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR PARTICULAR WEDDING.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
28. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVANT & VOW™ AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, WEDDING-RELATED EXPENSES, OR, WHERE LEGALLY PERMISSIBLE, EMOTIONAL DISTRESS OR MENTAL ANGUISH ARISING FROM OR RELATING TO THE SERVICE.
THIS INCLUDES DAMAGES ARISING FROM SERVICE INTERRUPTION, DATA LOSS, UNAUTHORIZED ACCESS, THIRD-PARTY FAILURES, AI-GENERATED CONTENT, ESTIMATES OR CALCULATIONS, VENDOR OR VENUE CONDUCT, OR PLANNING DECISIONS YOU MAKE.
OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID VIVANT & VOW™ FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT RESULT.
Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
29. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Vivant & Vow™ and its owners, employees, contractors, and affiliates from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising from Your Content, your unlawful or unauthorized use of the Service, your violation of these Terms, or your violation of another person's rights.
30. Force Majeure
Vivant & Vow™ will not be liable for delay or failure caused by events beyond our reasonable control, including severe weather, hurricanes, floods, fires, earthquakes, epidemics, war, terrorism, civil unrest, government action, labor disputes, power or telecommunications failures, Internet outages, cloud or hosting failures, widespread cyber incidents, or similar events.
31. Changes to These Terms
We may update these Terms as the Service, technology, pricing models, or applicable law changes. When we make material changes, we will provide notice and, where appropriate or required, ask you to review and accept the updated Terms before continuing to use affected features.
Non-material changes may take effect when posted. The Last Updated date and version number identify the current version.
32. Dispute Resolution
We would much rather solve a problem than argue about one. If you have a concern, contact support@vivantandvow.com, or billing@vivantandvow.com for billing matters. We ask that you give us thirty (30) days to work toward an informal resolution before initiating formal proceedings, unless applicable law requires otherwise.
If the matter is not resolved informally, disputes proceed as described in Section 33.
33. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, except to the extent federal law or another jurisdiction's non-waivable consumer protections apply.
Subject to any non-waivable rights you may have, disputes arising out of or relating to these Terms or the Service will be brought in the state courts located in Lee County, Florida, or the federal courts whose jurisdiction includes Lee County, Florida. You consent to personal jurisdiction and venue in those courts.
34. General Provisions
ENTIRE AGREEMENT. These Terms, the Privacy Policy, the plan and price terms shown at checkout, and any incorporated supplemental policies constitute the agreement between you and Vivant & Vow™ concerning the Service and supersede prior agreements about the same subject matter.
SEVERABILITY. If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions remain in effect.
NO WAIVER. Our failure to enforce a provision is not a waiver of the right to enforce it later.
ASSIGNMENT. You may not assign or transfer these Terms or your account without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, financing, or sale of all or part of our business or assets.
ELECTRONIC COMMUNICATIONS. You consent to receive account, activation, access, legal, billing, security, and service communications electronically at the email address associated with your purchase or account, subject to applicable law. Transactional communications are separate from optional marketing communications.
NOTICES. Notices to you may be sent to your purchase or account email address or presented through the Service. Legal notices to us should be sent to members@vivantandvow.com, or by mail to Vivant & Vow™, 2180 Andrea Lane, Suite #8, Fort Myers, FL 33912, USA, unless we designate another legal-notice address.
RELATIONSHIP. Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and Vivant & Vow™.
HEADINGS. Headings are for convenience and do not affect interpretation.
